Breakwater Journalism Festival

1. General Information

This Privacy Policy sets forth the rules for processing (any handling of personal data, whether it is storing, sharing, deleting or changing it) the personal data of users of the Breakwater Journalism Festival website (https://breakwaterfestival.org/) and newsletter subscribers.

The Controller of this personal data will be the Reporters Foundation, with its registered office in Warsaw, at ul. Narbutta 20, apt. 33, 02-541 Warsaw, KRS 0000367130, NIP 7010266708, REGON 142618684 (hereinafter: “the Foundation” or “the Controller”).

2. Scope of processing data

The Foundation may process the following personal data voluntarily provided by users:

  • first and last name,
  • email address,
  • contact details
  • other data necessary to process an inquiry or registration.

We may also process technical data related to the use of the website (e.g., IP address, cookies), solely for the purpose of ensuring its proper functioning and conducting statistical analysis.

3. Purposes of data processing

The Foundation may process personal data exclusively for the following purposes:

  • to provide information about the events, programs, and activities of the Breakwater Journalism Festival,
  • to send out the newsletter and other festival-related communications,
  • to handle correspondence and respond to inquiries,
  • to ensure the proper functioning of the website,
  • to fulfill the legal obligations incumbent upon the Controller.

4. Legal basis for processing

Data is processed on the basis of:

  • Article 6(1)(a) of the GDPR – user consent (newsletter, contact forms),
  • Article 6(1)(f) of the GDPR – the Controller’s legitimate interests (website analytics, security),
  • Article 6(1)(c) of the GDPR – legal obligations, where applicable.

These specific legal bases correspond to the purposes of processing as indicated in point 3 (above).

5. Data recipients

Data may be transferred to:

  • entities providing technical services to the Foundation (e.g., hosting providers, newsletter systems),
  • entities supporting the operation of the website and the festival.

Data will not be sold or shared with third parties for marketing purposes.

The provision of personal data is voluntary; however, in some cases, it may be necessary to perform specific services (e.g., sending a newsletter or responding to an inquiry). Failure to provide data may prevent an individual from accessing these services.

6. Transfer of data outside the EEA

If the tools used by the Foundation (e.g., the newsletter system) transfer data outside the European Economic Area, it will be done exclusively on the basis of appropriate safeguards as provided for in the GDPR (e.g., standard contractual clauses).

7. Data retention period

We retain data:

  • until consent is withdrawn – in the case of the newsletter,
  • for the period of time necessary to respond to and handle the contact – in the case of forms,
  • for as long as required by law or as is in the legitimate interests of the Controller.

8. User rights

Every data subject has the right to:

  • access  data,
  • rectify data,
  • erase data (“right to be forgotten”),
  • restrict processing,
  • object to processing,
  • withdraw consent at any time.

In cases where data is processed based on consent (e.g., newsletter), consent may be withdrawn at any time, in particular via the unsubscribe link in the email.

Withdrawal of consent does not affect the lawfulness of processing carried out prior to its withdrawal.

Every data subject also also has the right to file a complaint with the President of the Personal Data Protection Office.

9. Cookies

The website may use cookies for the following purposes:

  • ensure the proper functioning of the website,
  • conduct anonymous traffic analytics (e.g., Google Analytics),
  • optimize content.

For cookies other than those that are strictly necessary, the user gives consent via the cookie banner.

The user may change their cookie settings in their browser at any time.
